Terms of Service for Aucbuzz

Effective Date: October 18, 2025

1. Acceptance of Terms

By accessing, downloading, installing, or using the Aucbuzz application and platform (aucbuzz.com) ("App", "Service", "Platform", or "Aucbuzz"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the service.

These Terms constitute a legally binding agreement between you and Dedhia Technologies (dedhiatechnologies.com) ("we", "us", "our", or "Company"). By using our service, you represent that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction) and have the legal capacity to enter into this agreement.

2. Description of Service

Aucbuzz, a product of Dedhia Technologies, provides a comprehensive platform for hosting and managing virtual sports auctions and tournaments. Our service enables communities, societies, groups of friends, and sports organizations to organize and conduct player auctions in a digital environment.

Our service includes:

  • Creating and managing sports events, tournaments, and leagues
  • Player registration system through customizable Google Forms
  • Team and player management functionality
  • Real-time virtual auction features and bidding systems
  • Team assignment and roster management
  • Communication tools, including WhatsApp Business API integration for transactional notifications
  • Event scheduling and notification services
  • User profiles and community features
  • Tournament history and statistics

Third-Party Integrations: Our service integrates with third-party platforms, including Meta's WhatsApp Business Cloud API, Facebook Platform, and Google Forms. Use of these integrations is subject to their respective terms and policies, which you must also accept and comply with: Meta Platform Terms, Meta DFC Platform Terms, WhatsApp Business Terms, and Google Terms of Service.

3. User Accounts and Registration

To use certain features of our service, you must register for an account or register as a player for specific tournaments. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account at aucbuzz@gmail.com
  • Accept responsibility for all activities that occur under your account
  • Not create multiple accounts for fraudulent purposes
  • Not share your account credentials with others

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity.

4. Tournament Registration and Player Consent

When you register as a player for a virtual auction tournament through our Google Forms system, you acknowledge and agree to the following:

  • Registration Forms: Each community organizing a tournament uses our Google Forms registration system. While communities can customize certain fields (headers, footers, optional information), core fields (name, WhatsApp number, and communication consent) cannot be modified to ensure compliance with data protection and communication regulations.
  • Mandatory Information: You must provide your name and WhatsApp number to participate in tournaments. This information is necessary for tournament management and team assignment notifications.
  • Communication Consent: During registration, you will be presented with an explicit opt-in checkbox for receiving transactional communications via WhatsApp. This consent is voluntary, specific to the tournament you're registering for, separate for each tournament, and limited to transactional utility messages only (no marketing or promotional content).
  • Multiple Tournament Participation: If you participate in multiple communities or tournaments, you will complete a separate registration for each event. This ensures fresh consent, proper data segregation, and clear understanding of which tournament communications you're agreeing to receive.
  • Accuracy of Information: You are responsible for providing accurate contact information. Incorrect WhatsApp numbers may result in missed notifications about team assignments and tournament updates.

5. User Conduct and Prohibited Activities

You agree not to use the service to:

  • Violate any local, state, national, or international law or regulation
  • Infringe upon or violate the intellectual property rights, privacy rights, or any other rights of others
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, pornographic, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the service, servers, or networks connected to the service
  • Attempt to gain unauthorized access to any portion of the service, other accounts, computer systems, or networks
  • Use any automated means (bots, scrapers, crawlers, etc.) to access the service without our express written permission
  • Engage in any activity that could damage, disable, overburden, or impair our service or interfere with others' use of the service
  • Use the service for any illegal, fraudulent, or unauthorized purpose
  • Collect or store personal data about other users without their express consent
  • Send spam, unsolicited messages, or engage in any form of harassment through our platform
  • Upload or transmit viruses, malware, ransomware, or any other malicious code
  • Manipulate auctions or bidding processes through collusion, fraud, or artificial means
  • Create fake accounts or engage in identity fraud
  • Circumvent or disable any security features or access controls
  • Reverse engineer, decompile, or disassemble any part of our service
  • Use the service to compete with us or develop a competing product

Violation Consequences: Violation of these conduct rules may result in immediate suspension or termination of your account, removal from all tournaments, forfeiture of any fees paid, and may expose you to civil and criminal liability. We reserve the right to report illegal activities to appropriate law enforcement authorities.

6. WhatsApp Business Communication Terms

By opting in to receive WhatsApp communications through our registration process, you acknowledge and agree to the following:

  • Transactional Messages Only: We will only send you transactional utility messages related to your tournament participation, including team assignments, event updates, and auction-related notifications. We will NOT send marketing, promotional, or advertising messages.
  • Message Frequency: Message frequency varies based on tournament activity and your participation. Typical messages include registration confirmation, auction schedule notifications, team assignment notification (after auction completion), and critical tournament updates or changes.
  • Message and Data Rates: Standard messaging and data rates from your mobile carrier may apply. We are not responsible for any charges incurred from your carrier.
  • WhatsApp Requirements: You must have an active WhatsApp account with a valid phone number to receive messages. Messages are sent through Meta's WhatsApp Business Cloud API.
  • Opt-Out Rights: You can opt-out of WhatsApp communications at any time by replying "STOP", "UNSUBSCRIBE", or "OPT OUT" to any message from us, updating communication preferences in your account settings, or contacting us at aucbuzz@gmail.com. Opting out may result in you missing important tournament updates and team assignments.
  • WhatsApp Terms Apply: Your use of WhatsApp for receiving our messages is also subject to WhatsApp's Terms of Service and Privacy Policy. WhatsApp messages are end-to-end encrypted by WhatsApp's infrastructure.

7. Data Usage, Privacy, and User Rights

We are deeply committed to protecting your privacy and handling your data responsibly. This section summarizes our data practices, but please refer to our complete Privacy Policy for detailed information.

7.1 Data Collection and Use

Your data is collected and used exclusively to:

  • Provide and improve the virtual auction platform and tournament management features
  • Process registrations and manage tournament participation
  • Send transactional notifications about team assignments and tournament updates
  • Ensure platform security and prevent fraud
  • Comply with legal obligations

7.2 Data Protection Commitments

  • No Data Selling: We do not and will never sell your personal data to third parties.
  • No Marketing Without Consent: We do not use your data for third-party marketing purposes without your explicit consent. We do not send marketing or promotional WhatsApp messages.
  • Transparency: We are transparent about what data we collect, how we use it, and with whom we share it.
  • Security: We implement industry-standard security measures to protect your data.
  • Compliance: We comply with applicable data protection laws, including GDPR, CCPA, and other regulations.

7.3 Your Data Rights

You have comprehensive rights regarding your personal data:

  • Right to Access: Request access to the personal data we hold about you
  • Right to Rectification: Request correction of inaccurate or incomplete data
  • Right to Deletion (Right to be Forgotten): Request deletion of your personal data
  • Right to Data Portability: Request a copy of your data in a machine-readable format
  • Right to Withdraw Consent: Withdraw consent for data processing at any time
  • Right to Object: Object to certain types of data processing
  • Right to Restrict Processing: Request restricted processing in certain circumstances

7.4 Data Deletion

You can request deletion of your data at any time by emailing us at aucbuzz@gmail.com with "Data Deletion Request" in the subject line.

We will delete your data within 30 days, except for data we are legally required to retain. Your WhatsApp number will be immediately removed from all future messaging lists.

7.5 Data Sharing

We may share your data with:

  • Tournament Organizers: The community or organization that created the tournament you registered for needs your information to manage the event
  • Service Providers: Trusted third parties like Meta (WhatsApp Business API), Google (Forms), and cloud hosting providers who help us operate the platform
  • Legal Authorities: When required by law or to protect our rights

We never sell your data or share it for marketing purposes without your consent.

8. Community Organizer Responsibilities

If you are organizing a tournament or event using Aucbuzz, you agree to:

  • Use the platform in compliance with all applicable laws and regulations
  • Not modify mandatory registration form fields (name, WhatsApp number, communication consent)
  • Respect the privacy and data rights of registered players
  • Use player data only for the specific tournament purpose
  • Not share player data with unauthorized third parties
  • Ensure fair and transparent auction processes
  • Handle disputes within your community professionally
  • Not use the platform for commercial gain without our permission
  • Act as a joint data controller and comply with data protection obligations

Community organizers may be held liable for misuse of player data or violation of these terms.

9. Intellectual Property Rights

The Aucbuzz platform, including all content, features, functionality, software, code, design, graphics, logos, and trademarks, is owned by Dedhia Technologies and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our service for its intended purpose. You may not:

  • Copy, modify, distribute, sell, or lease any part of our service
  • Reverse engineer or attempt to extract the source code
  • Remove or alter any proprietary notices or labels
  • Use our trademarks, logos, or branding without permission
  • Create derivative works based on our service

10. User Content and License

When you submit content to our platform (player profiles, team names, event descriptions, etc.), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of operating and improving our service.

You represent and warrant that:

  • You own or have the right to submit the content
  • The content does not violate any third-party rights
  • The content complies with these Terms and applicable laws

We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

11. Fees and Payments

Some features of our service may require payment. If we introduce paid features:

  • Fees will be clearly disclosed before you make any payment
  • All fees are non-refundable unless otherwise stated or required by law
  • We reserve the right to change our pricing with reasonable notice
  • You are responsible for all taxes associated with your use of paid features
  • Payment processing is handled through secure third-party payment processors

Currently, our basic tournament and auction features are offered free of charge to communities. Premium features may be introduced in the future.

12. Disclaimer of Warranties

Our service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy or reliability of any information obtained through the service
  • Warranties that defects will be corrected

We do not warrant that our service will meet your requirements or that it will be compatible with all devices or systems. Use of our service is at your own risk.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Aucbuzz, Dedhia Technologies, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of or inability to access or use the service
  • Damages resulting from any conduct or content of any third party on the service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Damages arising from tournament disputes or auction outcomes

Our total liability to you for all claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Aucbuzz, Dedhia Technologies, and our officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content you submit to the platform
  • Your conduct in connection with the service

15. Termination and Suspension

We reserve the right to suspend or terminate your access to our service, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms of Service
  • Fraudulent, abusive, or illegal activity
  • Requests by law enforcement or other government agencies
  • Discontinuation or material modification of the service
  • Unexpected technical or security issues
  • Extended periods of inactivity
  • Non-payment of fees (for paid features)

You may terminate your account at any time by:

  • Using the account deletion feature in your settings
  • Contacting us at aucbuzz@gmail.com

Upon termination:

  • Your right to use the service will immediately cease
  • We will delete your personal data within 30 days (subject to legal retention requirements)
  • You will lose access to all content and data in your account
  • Certain provisions of these Terms (including indemnification, disclaimers, and limitations of liability) will survive termination

16. Dispute Resolution and Tournament Issues

While we provide the platform for virtual auctions, we are not responsible for disputes arising within tournaments or communities. We encourage fair play and sportsmanship, but:

  • Tournament organizers are responsible for resolving disputes within their events
  • We do not mediate disputes over auction outcomes, team assignments, or player selections
  • We do not refund fees or reverse auction results due to community disputes
  • Platform-level issues (bugs, technical errors) should be reported to us at aucbuzz@gmail.com

If you believe the platform itself has malfunctioned in a way that materially affected an auction, please contact us promptly with detailed information about the issue.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Mumbai, Maharashtra, India, and you consent to personal jurisdiction in such courts.

If you are located outside India, you acknowledge that by using our service, you are transferring your information to India and agree to such transfer.

18. Arbitration Agreement

For disputes arising out of or relating to these Terms or the service, you and Dedhia Technologies agree to resolve such disputes through binding arbitration, rather than in court, except that either party may seek injunctive or other equitable relief in court, and disputes may be brought in small claims court if they qualify.

Arbitration will be conducted in accordance with the Arbitration and Conciliation Act, 1996 (India). The arbitration shall be seated in Mumbai, Maharashtra, India, and conducted in English.

You agree that disputes will be resolved on an individual basis only, and not as a class action, consolidated action, or representative action.

19. Third-Party Platform Compliance

In using our service, you acknowledge and agree that:

  • Meta Platform Compliance: Our integration with WhatsApp Business API and Facebook Platform is subject to Meta's Platform Terms, DFC Platform Terms, and policies. We are committed to maintaining compliance with all Meta requirements, including obtaining explicit user consent before sending WhatsApp messages, only sending pre-approved transactional utility messages, respecting user opt-out requests immediately, maintaining proper data handling and privacy practices, and providing user data deletion capabilities.
  • Google Services: Our use of Google Forms and Google Cloud Services is subject to Google's Terms of Service and Privacy Policy.
  • Changes in Third-Party Terms: If third-party platforms (Meta, Google, etc.) change their terms or policies in ways that affect our service, we may need to modify or discontinue certain features. We will provide reasonable notice of such changes.

20. Export Controls and Sanctions

You agree not to use our service in violation of any export or import laws, regulations, or restrictions of India or any other jurisdiction. You represent that you are not located in, under the control of, or a national or resident of any country subject to international sanctions or embargoes.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

22. Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Dedhia Technologies.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the service, constitute the entire agreement between you and Dedhia Technologies regarding your use of the service and supersede any prior agreements or understandings.

24. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

25. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

26. Language and Translation

These Terms are originally written in English. If we provide a translation of these Terms, the English version will control in the event of any conflict or inconsistency between the English version and any translation.

27. Feedback and Suggestions

We welcome your feedback and suggestions about our service. Any feedback you provide will be deemed non-confidential and non-proprietary. We will be free to use such feedback without any obligation to you, and you hereby waive any rights you may have in such feedback.

28. Updates to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we make material changes to these Terms, we will notify you by posting the new Terms of Service on this page with an updated "Effective Date", sending you a notification through the app or via email, and for significant changes, displaying a prominent notice on our platform.

Material changes will be effective 30 days after posting, except for changes required by law which may be effective immediately. Your continued use of the service after changes become effective constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. If you do not agree to the modified Terms, you should discontinue your use of the service.
